В статье рассматривается реформаторский проект С.Е. Десницкого как одна из первых в истории отечественной правовой мысли попыток юридического осмысления преобразования российской монархии. Обосновывается, что предложенная С.Е. Десницким модель разграничения законодательной, судительной, наказательной и гражданской власти была направлена на правовое упорядочение самодержавия. Особое внимание уделяется идее монарха как верховного арбитра в системе разграничения властей и ее значению для дальнейшего развития отечественной конституционной традиции.

The article examines Semyon Desnitsky’s reform project as one of the earliest attempts in the history of Russian legal thought to provide a juridical understanding of the transformation of the Russian monarchy. It is argued that Semyon Desnitsky’s proposed model of distinguishing legislative, judicial, punitive, and civil authority was aimed not at rejecting autocracy, but at giving it a legally ordered form. Particular attention is paid to the idea of the monarch as the supreme arbiter within the system of differentiated powers and to the significance of this idea for the subsequent development of the Russian constitutional tradition.
