Актуальность исследования обусловлена устойчивым ростом числа уголовных дел, рассматриваемых в отсутствие подсудимого по правилам части 5 статьи 247 УПК РФ, а также необходимостью оценить, насколько процессуальная оптимизация совместима с гарантиями права осужденного на защиту. Автор исходит из того, что заочный приговор является особым объектом судебной проверки, поскольку постановляется в ситуации, когда подсудимый не участвует в судебном разбирательстве лично, а его отношение к исследуемым доказательствам и отдельным обстоятельствам дела может выражаться лишь опосредованно — через защитника и процессуальные документы. В статье анализируются аргументы в пользу единоличного пересмотра, рассматриваются риски формализации апелляционной и кассационной проверки, а также раскрываются гарантии, позволяющие сохранить баланс между эффективностью уголовного судопроизводства и правами отсутствующего лица. Особое внимание уделяется обязательному участию защитника, надлежащему извещению осужденного, направлению процессуальных документов, праву на перевод и возможности последующей отмены заочного приговора при устранении обстоятельств, предусмотренных законом.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the issues of appellate and cassation review of sentences in absentia in Russian criminal proceedings in connection with the legislative initiative of the Supreme Court of the Russian Federation aimed at introducing single-judge consideration of this category of cases in review courts. The relevance of the research is determined by the steady increase in the number of criminal cases heard in the absence of the defendant under part 5 of Article 247 of the Criminal Procedure Code of the Russian Federation, as well as by the need to assess whether procedural optimization is compatible with the guarantees of the convicted person’s right to defence. The author proceeds from the idea that a sentence in absentia is a special object of judicial review, since it is delivered in a situation where the defendant does not personally participate in the trial, while his procedural attitude to the evidence and particular circumstances of the case can be expressed only indirectly, through defence counsel and procedural submissions. The article analyzes arguments in favour of single-judge review, considers the risks of formalizing appellate and cassation control, and identifies the guarantees necessary to maintain a balance between the efficiency of criminal proceedings and the rights of the absent person.
