В статье исследуются теоретические и прикладные аспекты законодательного конструирования составов преступлений, содержащихся в главе 26 Уголовного кодекса Республики Беларусь (далее УК) – преступления против экологической безопасности, окружающей среды и порядка природопользования (далее «экологические преступления»), предусмотренные ст. 281 УК «Незаконная добыча рыбы или других водных животных» и ст. 282 УК «Незаконная охота». Особое внимание уделено моменту окончания данных составов и спорным вопросам в его определении в контексте законодательных изменений уголовно-правовых норм о незаконной добыче рыбы или других водных животных и незаконной охоты. Цель работы – определение конструкции данных составов по признакам объективной стороны и уточнение момента юридического окончания таких преступлений для правильной квалификации.

The article examines the theoretical and applied aspects of the legislative construction of crimes contained in Chapter 26 of the Criminal Code of the Republic of Belarus (hereinafter referred to as the Criminal Code) - crimes against environmental safety, the environment and the management of natural resources (hereinafter referred to as “environmental crimes”), provided for in Art. 281 of the Criminal Code “Illegal harvesting of fish or other aquatic animals” and Art. 282 of the Criminal Code “Illegal hunting”. Particular attention is paid to the moment of termination of these compositions and controversial issues in its definition in the context of legislative changes in criminal law on illegal fishing or other aquatic animals and illegal hunting. The purpose of the work is to determine the design of these compounds based on the characteristics of the objective side and clarify the moment of the legal termination of such crimes for correct qualification.
