Обосновывается, что цифровая среда не создает полностью автономного каталога прав, но изменяет условия осуществления достоинства личности, неприкосновенности частной жизни, равенства, свободы информации и судебной защиты. Раскрывается содержание информационного самоопределения как возможности лица понимать и в разумных пределах контролировать жизненный цикл относящихся к нему данных. Предлагается конституционный стандарт автоматизированного публичного решения, включающий законность, определенность цели, минимизацию данных, проверяемость, объяснимость, человеческий пересмотр, недискриминацию, безопасность, обратимость и цифровую инклюзию. Вводится понятие права на конституционно значимое объяснение решения, существенно затрагивающего статус личности. Сформулированы предложения об обязательной оценке воздействия алгоритмических систем на права человека, реестре высокорисковых государственных алгоритмов, сохранении нецифровой альтернативы и специальных средствах доказывания алгоритмической дискриминации.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines how the mechanism of constitutional guarantees of human rights is transformed by digital public administration and large-scale data processing. It is argued that the digital environment does not create a fully autonomous catalogue of rights, but changes the conditions for exercising human dignity, privacy, equality, freedom of information, and judicial protection. Informational self-determination is defined as the individual’s ability to understand and, within reasonable limits, control the life cycle of data relating to them. A constitutional standard for automated public decisions is proposed, including legality, purpose specification, data minimization, auditability, explainability, human review, non-discrimination, security, reversibility, and digital inclusion.
